Well, a publication shutting down does not remove or revoke the copyright, which usually lasts decades, so making and distributing copies would technically violate copyright law. However, I’d say the most anyone would do to you for scanning PDFs, is send a strongly worded cease and desist letter, if they found out or cared.

Whether the copyright still exists and whether or not you are likely to get sued are two different questions. Someone will still hold the IP rights.
